Inheritance tax: New probate rules to delay plans as a conflict with HMRC is identified


These new changes are set to affect many in the coming months as according to the Ministry of Justice, the new alterations should see around three-quarters of professional user applications move online.

However, according to Debra Burton, a Legal Director at Lime Solicitors, these coming changes may face hurdles in the coming week and months, as she explained: “Online probate registry applications for solicitors are now mandatory – but the process is far from complete.

“At the moment the system can only be used to get straightforward grants of probate i.e. there has to be a will.

“It cannot be used if there is an intestacy – a significant proportion of people still die without a Will so they cannot use the system yet.
